Madison County Landscaping, LLC ("Company," "we," "us") offers free on-site consultations for property owners within our service area. A consultation is a visit to your property where we listen to your goals, assess your landscape conditions, and discuss possibilities. There is no cost for this visit and no obligation to proceed.
Following the consultation, if the project requires professional landscape design, a design fee may apply. The design fee covers the preparation of a detailed plan including plant selections, layout drawings, material specifications, and a written proposal. The design fee amount varies by project scope and will be discussed with you before any charges are incurred.
For projects that do not require formal design work — such as basic lawn care, simple bed maintenance, mulching, or straightforward plant replacements — the design fee is typically waived. When a design fee is charged and the customer proceeds with the installation, the design fee is credited toward the total project cost, effectively making the design free.
All landscaping work beyond the initial consultation is performed under a separate written service agreement. No work will be scheduled or performed until a signed agreement and the required deposit are received by the Company.
Service agreements include a detailed scope of work, total pricing, payment schedule, warranty terms, customer responsibilities, change order procedures, and cancellation terms. Pricing in a signed agreement is fixed and will not increase due to vendor cost changes after the agreement is executed and deposit is received.
Any changes to the agreed scope of work require a written Change Order signed by both parties before the additional or modified work is performed. Verbal agreements to change scope are not binding.
A deposit is required before work is scheduled. The deposit amount is specified in your service agreement, typically 50% of the total project cost. The balance is due upon completion unless otherwise specified.
We accept payment by credit card, debit card, bank transfer, check, or cash. For payments by check, please allow adequate time for bank processing. A returned check fee of $35.00 applies to any check returned for insufficient funds.
If payment is not received within 30 days of the invoice date, the account is considered past due. Past due accounts may be subject to a late fee of 1.5% per month on the outstanding balance.
Plants installed by Madison County Landscaping are warranted for twelve (12) months from the date of installation against death due to disease or defect, subject to the following conditions:
Hardscape installations including patios, retaining walls, walkways, and fire features are warranted for twenty-four (24) months against defects in workmanship. This includes settling greater than one-half inch, lateral shifting, and drainage failure attributable to installation error. Natural stone color variation, hairline surface cracking, and efflorescence are not considered defects.
General workmanship on all installations is warranted for twelve (12) months from completion. This covers irrigation system leaks related to our installation, grading and drainage performance under normal conditions, and structural integrity of any constructed features.

Failure to meet these responsibilities may void applicable warranties and relieve the Company of liability for resulting damage or plant loss.
We serve properties in Madison County, Alabama and portions of Lincoln County, Tennessee. Our primary service communities include Huntsville, Madison, Hazel Green, Harvest, Meridianville, and surrounding areas, as well as Fayetteville, Tennessee. Service availability for properties outside these areas is determined on a case-by-case basis — please contact us to discuss your specific location.
Madison County Landscaping, LLC reserves the right to decline or discontinue service to any property or individual, for any reason or no reason, at the Company's sole discretion. This includes but is not limited to properties outside our service area, properties presenting unsafe working conditions, situations where we determine we cannot deliver the quality of work our customers expect, or circumstances where continued service is not in the best interest of our team or our business.
Our membership program (Seedling, Grower, and Cultivator tiers) is billed monthly through Stripe. Memberships are month-to-month with no long-term commitment. You may cancel at any time from your member dashboard or by contacting us. Cancellation takes effect at the end of the current billing period — you retain access through the date you have already paid for.
Member discounts apply to services booked through the Company and products purchased through our website. Discounts cannot be combined with other promotions unless explicitly stated. Membership benefits, pricing, and included features may be updated from time to time. We will provide notice of material changes via email.

Plant recommendations, growing guides, and blog content are provided for general educational purposes based on conditions typical to USDA Hardiness Zones 7 and 8 in Madison County, Alabama and Lincoln County, Tennessee. Results may vary by specific property conditions. We recommend soil testing before making major amendments or planting decisions.
The Company's total liability under any service agreement shall not exceed the total contract price for that agreement. We shall not be liable for incidental, consequential, or punitive damages. We shall not be liable for damage to underground utilities, irrigation lines, or structures not disclosed by the customer or not marked by the applicable utility locating service.
Madison County Landscaping, LLC carries comprehensive general liability insurance and workers' compensation insurance. Certificates of insurance are available upon request.
If you cancel a service agreement before materials have been ordered, the deposit will be refunded less a cancellation fee of 15% of the total contract price or $250, whichever is greater. If materials have already been ordered, the deposit is non-refundable and you are responsible for non-returnable material costs. If work has begun, you will be invoiced for all work completed at contract rates plus a mobilization fee of $150.
If a dispute arises, we agree to first attempt resolution through direct conversation in good faith. If that does not resolve the matter within 30 days, we agree to submit the dispute to mediation in Madison County, Alabama before pursuing any other remedy. Mediation costs are shared equally. This agreement is governed by the laws of the State of Alabama.
